Terms of service

These General Terms and Conditions (hereinafter "GTC") shall apply to all orders placed by consumers through our online shop at https://zerziiv.com as well as through our other distribution channels (e.g. Amazon Marketplace).

A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity (§ 13 of the German Civil Code, "BGB").

Amazon Marketplace
For purchases made via Amazon Marketplace, the contract is processed through Amazon. The terms of use of Amazon shall apply additionally: https://www.amazon.de/gp/help/customer/display.html?nodeId=201909000

Sales to commercial customers (B2B) and wholesale customers shall not be processed through the online shop but exclusively through our business premises. Wholesale customers are kindly asked to contact us directly at:

3. Conclusion of Contract

The presentation of products in the shop does not constitute a legally binding offer. Only by clicking the "Buy Now" button do you submit a binding offer. The contract is concluded once we accept your order by way of a confirmation email.

Correction of Input Errors: Prior to submitting your order, you may correct your entries at any time using the standard keyboard and browser functions; additional correction options are displayed during the ordering process.

3a. Product Representations

Our jewelry pieces are carefully crafted in selected manufactures, with many pieces – in particular pearl and natural stone pieces – produced entirely by hand. Minor deviations in shape, size, structure, or color attributable to production or material characteristics are possible and shall not constitute a defect. Product images are for illustrative purposes only; slight differences from the delivered item are unavoidable and reflect the individuality of each piece.

4. Contract Language & Storage

The contract language is German. We store the contract text; you will receive the order data by email. You can view past orders in your customer account. Our GTC and the cancellation policy can be accessed at any time on our website.

5. Prices and Payment

All prices are final prices and include the statutory value-added tax (VAT).

Shipping and delivery costs will be charged in addition to the purchase price and shown separately during the ordering process. For deliveries to non-EU countries, additional customs duties, taxes, or fees may apply, which shall be borne by the customer. Currency conversion or transaction fees may also arise within the EU if payment is made through a bank account or payment service provider located outside the EU; such costs shall be borne by the customer.

Shopify Payments
Payment may be made via Shopify Payments. Payment processing is carried out by Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland ("Stripe"). Available payment methods (e.g. credit card, SEPA Direct Debit, Apple Pay, Google Pay) will be displayed during the ordering process. PayPal
Payment may also be made via PayPal. Payment processing is carried out by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg. During the ordering process, the customer is redirected to the PayPal website to complete the payment. The PayPal account is debited immediately upon completion of the order. The use of PayPal requires a PayPal account or the use of PayPal's guest checkout function. 6. Delivery and Shipping

We deliver within Germany, to the European Union, and internationally.

Delivery is made to the delivery address provided during the ordering process; in the case of PayPal, the delivery address stored with PayPal shall be exclusively decisive.

The goods shall remain our property until full payment has been received.

Transfer of Risk: When goods are shipped to consumers, the risk of accidental loss and accidental deterioration shall only pass to the customer upon delivery of the goods.

Undeliverable Shipments: If a delivery cannot be completed due to incorrect address details or refusal of acceptance by the customer, and the shipment is returned to us, the customer shall bear the return shipping costs. The customer shall also bear the renewed shipping costs for any further delivery attempt.

7. Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal of 14 days.

Excluded from this right, for reasons of health protection or hygiene, are sealed items such as earrings and piercings, where the seal has been removed after delivery.

Returns in Case of Withdrawal:
The return must be registered with us in advance by email (info@zerziiv.com).

  • Germany: Upon request, we provide a DHL return label. The associated costs (currently € 7.91) shall be deducted from the refund amount.
  • International (EU and Non-EU): We do not provide a return label. Please organize the return shipment yourself; the costs incurred shall be borne by you.

Returns in Case of Defective Goods:
If the goods have been delivered defective or damaged, we shall bear the return shipping costs within the scope of statutory warranty obligations. Outside the EU, processing may differ. Please contact us in advance by email to clarify the return modalities on an individual basis.

The return must be complete. The scope of delivery includes, in addition to the jewelry piece itself, the corresponding jewelry box or jewelry case. A refund shall be made exclusively if the goods are returned to us in complete and undamaged condition.

8. Liability for Defects (Statutory Warranty)

The statutory provisions on liability for defects shall apply. The statutory warranty period is 24 months from delivery of the goods.

8a. Voluntary Guarantee

(1) General Provisions
In addition to the statutory rights for defects pursuant to Section 8, ZerZiv GmbH grants consumers a voluntary guarantee covering material and manufacturing defects of its jewelry pieces in accordance with the following provisions. This guarantee constitutes an additional, voluntary benefit and exists independently of statutory warranty claims pursuant to §§ 433 et seq. of the German Civil Code (BGB). The statutory rights of the customer shall not be limited by this guarantee.

(2) Guarantee Period and Eligibility

  • 24 months from the date of purchase for jewelry pieces with stainless steel as the base material.
  • 12 months from the date of purchase for jewelry pieces with brass as the base material.

The date of purchase as shown on the order confirmation shall be decisive for the commencement of the guarantee period. Guarantee claims are non-transferable and can only be asserted by the original purchaser upon presentation of the original proof of purchase.

(3) Scope of the Guarantee
The guarantee covers material and manufacturing defects that occur under normal, intended use and which significantly impair the function or value of the jewelry piece.

(4) Exclusions
The guarantee shall not cover, in particular:

  • Natural products such as freshwater pearls, natural stones, and shells, whose natural characteristics (shape, color, grain, size) may deviate from the product images
  • Damage resulting from improper use, negligent use, accidents, falls, bending, snagging, or mechanical impact
  • Knotting or tangling of chains or chain links
  • Damage resulting from contact with perfume, creams, soap, make-up, hairspray, disinfectants, or other chemicals
  • Damage resulting from contact with chlorinated or salt water (e.g. swimming pool, sea)
  • Damage resulting from sports activities, perspiration, or adhesive substances
  • Damage to brass pieces caused by any water contact beyond brief splashes
  • Damage caused by unsuitable cleaning agents or methods (silver dips, immersion cleaners, ultrasonic cleaners, steam cleaners, bleach, toothpaste, household remedies)
  • Damage caused by improper storage or independent modification
  • Ordinary signs of wear and tear (e.g. scratches, patina, loss of shine)
  • Soiling on the product
  • Damage caused by unauthorized repair or modification by third parties

(5) Guarantee Performance
If a guarantee claim is recognized, ZerZiv shall provide one of the following remedies in the following order:

  1. Equivalent Replacement: The customer may select a product from the current range with a value equal to the original purchase price (chain for chain, bracelet for bracelet, earring for earring, etc.).
  2. Direct Replacement: Subject to availability and at the customer's request, an identical product may be provided as replacement.
  3. Voucher: If the customer does not wish to receive a replacement, the guarantee shall be fulfilled by way of a voucher in the amount of the original purchase price of the affected jewelry piece.

Repair shall not be performed. Cash payment as well as compensation for damages, indirect damages, consequential damages, and loss of profit are excluded. The guarantee performance shall be limited in amount to the original purchase price of the affected jewelry piece.

Any guarantee performance rendered shall neither extend the guarantee period nor cause it to begin anew.

(6) Assertion of the Guarantee
Guarantee claims must be reported within the guarantee period by email to info@zerziiv.com. The notification shall include:

  • Original proof of purchase or order number
  • Brief description of the defect
  • At least two meaningful photographs clearly showing the defect in question

ZerZiv shall review the claim, as a rule, within 10 business days and shall communicate the result and further procedure. The product may only be returned upon written request by ZerZiv. The return shipping costs shall initially be borne by the customer; in the event of a recognized guarantee claim, ZerZiv shall reimburse the documented return shipping costs.

(7) No Acknowledgment of Liability
A guarantee performance may, in individual cases, also be rendered as a gesture of goodwill. In no event shall the performance of a guarantee constitute an acknowledgment of a defect or establish a precedent for further claims.

(8) Manufacturer Guarantees
Any manufacturer guarantees shall remain unaffected; their terms shall be determined by the respective manufacturer's guarantee declaration.

9. Liability / Limitation of Liability

(1) In all cases of contractual and non-contractual claims, we shall be liable to the customer for damages or reimbursement of futile expenses in cases of intent and gross negligence in accordance with the statutory provisions.

(2) In all other cases, we shall be liable – unless otherwise provided in paragraph 3 – only in the event of a breach of an essential contractual obligation. Essential obligations are those whose fulfillment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely (so-called cardinal obligations). In such cases, liability shall be limited to compensation for damages typically foreseeable at the time of conclusion of the contract. In all other cases, our liability shall be – subject to paragraph 3 – excluded.

(3) Unaffected shall remain our liability for damages arising from injury to life, body, or health, as well as our mandatory liability under the Product Liability Act (Produkthaftungsgesetz).

10. Set-Off / Right of Retention

A right of retention is granted to consumers only insofar as it arises from the same contractual relationship. Consumers shall be entitled to set-off only with undisputed claims or claims that have been established by final court decision.

11. Force Majeure

Events beyond our control (e.g. natural events, pandemics, governmental measures, strikes, significant disruptions of shipping or payment service providers) may temporarily affect the performance of the contract. We shall inform you without undue delay; statutory rights (in particular withdrawal/refund) shall remain unaffected.

12. Amendments to the GTC

The version of these GTC valid at the time of the order shall apply. Subsequent amendments shall not have retroactive effect.

13. Applicable Law

German law shall apply to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

14. Alternative Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
