1. Scope

These General Terms and Conditions (GTC) apply to all orders placed by consumers via our online shop at https://zerziiv.com as well as through our other sales channels (e.g. Amazon Marketplace).

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 BGB).

Amazon Marketplace
For purchases made via Amazon Marketplace, the contract is processed by Amazon. In addition, Amazon’s terms of use apply: https://www.amazon.de/gp/help/customer/display.html?nodeId=201909000

Sales to businesses (B2B) and wholesale customers are not conducted via the online shop but exclusively through our business premises. Wholesale customers are kindly requested to contact us directly:

3. Conclusion of Contract

The presentation of products in the shop does not constitute a legally binding offer. By clicking the “Buy Now” button, you submit a binding offer to purchase. The contract is concluded when we accept your order by sending you a confirmation e-mail.

Correction of Input Errors: Before submitting the order, you may correct your entries at any time using the usual keyboard and browser functions; additional correction options are provided during the order process.

3a. Product Presentation

All jewelry offered by us is handmade. Minor deviations in shape, size, texture, or color due to production or materials are possible and do not constitute a defect. Product images are for illustrative purposes only; slight differences compared to the delivered item are unavoidable and highlight the uniqueness of each piece of jewelry.

4. Contract Language & Storage

The contract language is German. We store the text of the contract; the order details will be sent to you by e-mail. Past orders can be viewed in your customer account. Our GTC and the cancellation policy can be accessed at any time on our website.

5. Prices and Payment

All prices are final prices and include the statutory value-added tax (VAT).

In addition to the purchase price, delivery and shipping costs apply, which are shown separately during the order process. For deliveries to non-EU countries, additional customs duties, taxes, or fees may apply, which must be borne by the customer. Even within the EU, conversion or transaction fees may arise if payment is made from a bank account or through a payment provider outside the EU; such costs are borne by the customer.

Shopify Payments
Payment may be made via Shopify Payments. Payment processing is carried out by Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland (“Stripe”). Available payment methods (e.g. credit card, SEPA direct debit, Apple Pay, Google Pay) are displayed during the order process. PayPal
Payment may also be made via PayPal. Payment processing is carried out by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg. During the ordering process, the customer is redirected to the PayPal website to complete the payment. The PayPal account will be charged immediately upon completion of the order. 6. Delivery and Shipping

We deliver within Germany, to the European Union, and internationally.

Delivery will be made to the shipping address specified during the order process; for PayPal payments, only the delivery address registered with PayPal is valid.

The goods remain our property until full payment has been received.

Transfer of Risk: When shipping to consumers, the risk of accidental loss or accidental deterioration of the goods passes to the customer only upon delivery.

Undeliverable Shipments: If a delivery cannot be completed due to incorrect address details provided by the customer or because the customer refuses to accept the goods and the shipment is returned to us, the customer shall bear the costs incurred for the return. Any costs for reshipment shall also be borne by the customer.

7. Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal of 14 days.

Exceptions apply for sealed goods which, for health protection or hygiene reasons, are not suitable for return if their seal has been removed after delivery (e.g. earrings and piercings).

Return in the Event of Withdrawal:
The return must be registered with us in advance by e-mail (info@zerziiv.com).

  • Germany: Upon request, we will provide a DHL return label. The cost of this label (currently €7.91) will be deducted from the refund amount.
  • Abroad (EU and non-EU): We do not provide a return label. Please organize the return shipment independently; the costs are to be borne by you.

Returns in Case of Defective Goods:
If the goods are delivered faulty or damaged, we will bear the return costs within the framework of the statutory warranty obligations. Outside the EU, the procedure may differ. In such cases, please contact us in advance by e-mail to clarify the return arrangements individually.

The return must be complete. In addition to the piece of jewelry, the corresponding jewelry box or case must also be returned. A refund will only be made if the goods are returned to us in full and undamaged.

8. Liability for Defects (Warranty)

The statutory warranty rights apply.

8a. Guarantee

We do not provide any voluntary guarantees beyond the statutory rights. Any manufacturer guarantees remain unaffected; their terms and conditions can be found in the respective manufacturer’s guarantee declaration.

9. Liability / Limitation of Liability

(1) We shall be liable to the customer in all cases of contractual and non-contractual claims for damages or reimbursement of futile expenses in the event of intent or gross negligence in accordance with statutory provisions.

(2) In all other cases – unless otherwise provided for in paragraph 3 – we shall only be liable if a material contractual obligation has been breached. Material obligations are those obligations whose fulfilment is essential for the proper performance of the contract and on which the customer may regularly rely (so-called cardinal obligations). In such cases, liability shall be limited to the compensation of the foreseeable, typical damage at the time of conclusion of the contract. In all other cases, our liability is excluded – subject to paragraph 3.

(3) Our liability for damages resulting from injury to life, body, or health, as well as our mandatory liability under the Product Liability Act, remain unaffected.

10. Set-off / Right of Retention

Consumers shall only be entitled to a right of retention if it arises from the same contractual relationship. Consumers shall only be entitled to set-off if their claims are undisputed or have been legally established by a final judgment.

11. Force Majeure

Events beyond our control (e.g. natural disasters, pandemics, official measures, strikes, major disruptions at shipping or payment service providers) may temporarily impair the performance of the contract. We will inform you immediately; statutory rights (in particular rescission/refund) remain unaffected.

12. Amendments to the GTC

The version of these GTC valid at the time of the order shall apply. Subsequent amendments shall not have retroactive effect.

13. Applicable Law

German law shall apply to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

14. Alternative Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
